FALSE RAPE ACCUSATION 28 WITNESSES:
Sharleeta Marshall
The
clear message of this prosecution is that survivors of sexual assault must be
able to prove their own innocence or face prosecution when they report a sexual
assault crime. This report of Sharleeta Marshall sexual assault is false and
was never adequately investigated by Carbondale Police Department.
CRIMINAL JUSTICE MAJOR SHARLEETA MARSHALL WILLINGLY DEFIED THE LAW ALONGSIDE CARBONDALE POLICE DEPARTMENT, TO RAILROAD BLACK COLLEGE STUDENT SHAMAR SCALES.
Marshall
fabricated a rape accusation she started in April of 2013. She admits to the
court that she was pretending to be asleep during an alleged sexual assault and
jury still convicts the accused. She was drunk and Carbondale Police later
switched her story to show she was asleep. Police allowed her to switch her
story and assisted her in railroading FALSELY CONVICTED STUDENT Shamar Scales.
Marshall committed perjury by claiming to have slept through sexual intercourse
and not UNDER THE INFLUENCE OF ALCOHOL OR ANY DRUG. She admitted to the first
person she called and multiple witnesses that WEREN’T allowed to testify DUE TO
RACIAL DISCRIMINATION that she was indeed drunk. She claims she had no
awareness she was having sex with a childhood friend/college roommate because
she managed to sleep through the whole act and was “suddenly awaken”. In order
to claim this has happened she would have had to be diagnosed with the Sleep
Sex Disorder, this rare sleeping disorder is known as Sexsomnia (NREM)
parasomnia which she was not diagnosed with.
"If someone steals from you and it takes a week to get to the bottom of the case there is no lasting harm done, you catch the perpetrator, get your things back, life goes on so there is no reason to CRY THEFT! On the other hand if you're getting murdered or raped or see an out of control fire you cry out right then and there. You cry out right then and there so the community can respond immediately and help you fight off the attacker or kill the wolf, or put out the fire."
April 12th 2013 at approximately 4:00am Sharleeta Marshall called Shiranette Scales stating "I was drunk, I was having sex with your brother, he had sex with me while I was asleep, he raped me."
Shiranette: Whose home with you?
Sharleeta: My Brother and Laneal
Shiranette: If you were being raped why haven't you called the police? or at the hospital? what can i do? Why didn't you wake up your brothers, i'm not there and where is my brother?
Sharleeta: I told him to leave that's the only question she answered out of the five.
Shiranette heard a knock at the door, it was her
Brother. Sharleeta then hung up the phone after hearing Shamar's voice. The
fact that she did not wake her brothers raised the 1st red flag stated
Shiranette. "As a young girl my mom always taught me that if I were
getting raped to call the police and then call her, but first and foremost
scream and yell for dear life to get somebodies help. So I just couldn't
understand why she wouldn't scream. Isn't this sexual act unwanted? Rape is
serious.”

Sharleeta Marshall and Shiranette Scales
were best friends, more like family in which they addressed each other as
cousins. Shiranette, Shamar, Sharleeta, and Isaiah grew up together in
Concordia Park Apartments where they all attended W.E.B Dubious Elementary
School where Marshall’s mother worked. They were all very close and were long
lasting friends. The Students also shared a home together in Carbondale, IL
where they attended college. Shamar attended John A Logan College, while the
others attended SIUC. In 2009 Shiranette and Shamar stayed off campus and Sharleeta
stayed in Neely Hall on campus. Sharleeta spent the majority of her nights at
Shiranette's apartment in which she slept in the same space as Shamar. Shamar
also slept in her dorm an abundant amount of nights while she stayed in Neely
Hall. They always slept together. Shiranette and Sharleeta got an apartment
together when Marshall moved off campus the 2010-11 school year and remained
roommates for the 2011-12 school year. Shamar didn't reside with the two during
the 2010-11 school year because he went back to Chicago. He moved back and
registered into college the 2011-12 school year in which he shared a home with
the two women once again. While Shiranette and Marshall were roommates Shamar
either slept on the front couch if Sharleeta and Shiranette had company, or in the room with
Sharleeta. Shamar also slept in her room in her bed when she was not home, he
was always allowed in her room in her bed. This was their normal routine.
False accusation of rape is the
intentional reporting of a rape by an alleged victim when no rape has occurred.
The key element is this victim’s account of sexual assault were internally
inconsistent and directly contradicted by multiple witnesses. Since the victim
altered those key elements of her accounts investigators should have concluded
that this report is false. During the 2012-13 school year Scales and Marshall
did not room together, they were getting ready to graduate and parted ways.
Marshall moved in with her brother and Laneal Nance while Scales resided with
Brielle Welch and Shamar resided with Shaun Strauther and Damon Troope, whom
are also friends of The Marshall's and Laneal Nance. All of the parties were
welcome in each other homes with no limitations and considered each other
family. At the time of the alleged rape both Sharleeta’s brother Isaiah Marshall
and Laneal Nance were home. She never made them aware she was being assaulted
or "raped". She left them asleep to call suspect’s sister. During
this alleged assault she never screamed, yelled, or told the suspect to stop
during sexual intercourse. Both men were in house while the rape supposedly
occurred and are still currently active in the Army's National Guard. They are
trained to serve and protect this country. Why wouldn't they protect their
sister if she was being harmed in the same home with them? Why didn't victim
wake up her brother? The victim decided to wake up one of the men in home after
she managed to call suspects sister 4-5 times before suspect made it down to
sister’s home. The distance between their homes is 3 minutes walking and Shamar
rode a bike down there. How did she manage to be so concerned with calling
Shiranette when she was just assaulted and raped and help was in home? Victim
finally wakes up Isaiah but leave Laneal asleep. Sharleeta then DRIVES herself
to the hospital and decides to be a taxi and went to pick up Raphael Hayden an
ex intimate partner. Raphael is also a mutual friend of all parties. Sharleeta,
Isaiah, and Raphael then proceed to the hospital. At the hospital she gave
statements and told the police she was drunk but later switched her story to say
she was just SLEEP and not DRUNK. Marshall notified Shiranette of her
proceeding to Memorial Hospital for a rape kit. After Shiranette secured
Shamar's safety, she took her god daughter home to her mother and went to the
hospital to see if Sharleeta was OK, really hurt and to hear her story again.
When Shiranette got to Memorial Hospital she saw Raphael Hayden and was
informed that Sharleeta DROVE to pick him up. This raised the 2nd red flag.
Shiranette: Can you tell me your story again?
Sharleeta: I was drunk and girl i thought i was dreaming then i realized it was your brother. So i waited for a minute and don't you know how after a boy ejaculates (cum), and you thrust out of him, that's what i did, then i turned around and he had the covers on him then i told him to get up and leave he left. Then i called you.
Shiranette: Why did you call me first if your brothers were home? Sharleeta were you getting raped? Did you scream? yell? fight him off? Did he hurt you? hit you? force you? What position were you in?
Sharleeta: Yea i was getting raped, no i didn't scream or nothing, he didn't hit me or hurt me or nothing! She never answered questions 1, 5, and 8.
Shiranette then left the hospital, the way Sharleeta answered/disregarded questions raised 3rd red flag. Shiranette then notified her mom of the accusation Sharleeta has started. Shiranette then went to check on her brother along with another childhood friend and current roommate Brielle Welch.
Shiranette: Whats up Bro
Shamar: Whats good Sis
Shiranette: Sharleeta talking about you raped her are you aware of this? She just told me two different stories though. What happened last night? Were you all drunk?
Shamar: What? Man she knew what she was doing. We all kicked it that night for Deon Birthday. We went out. We pre-gamed at Isaiah them crib went to Kenny and Dame crib, then went to the bar. Laneal, Isaiah, and I went back to they house and i guess Deon went back to Kenny them crib. Isaiah was messed up i helped him up the stairs and to his room and i put him in his bed. Then I went and got in the bed with Sharleeta like i would normally sleep in the bed with her. She got freaky like she always do on some drunk stuff. We both was drunk everybody was drunk. How could i rape her Laneal and Isaiah was in this house I helped Isaiah in the house. She helped me take her clothes off and everything she tweaking, she knew what she was doing. She got up and turned on the TV and turned out the light then laid back down in front of me we were side ways. After we was done she told me don't tell nobody and to leave. She started tweaking asking was i gone tell somebody and told me to leave. You stay up the street, so i didn't care and i rode the bike down to your house. Her bed was on Isaiah's wall he would have heard me raping her and come on now Sharleeta would have fought me. She would fight anybody. Shira she lien. I guess she didn't want you to know we had sex.
Shiranette: You all stories match she just not trying to admit to certain parts and left out certain parts. Man i don't know what she doing i just hope she not trying to press charges or nothing this serious and brother you gone go to jail, they gone automatically believe her here, what we gone do?
Shamar: Shit i'm gone fight it. We gone fight it.
Shiranette: Alright I promise. Watch your back I love you, stay here; don't leave without calling me. And Call Mama.
Shamar: Alright Sister I love you too.
"Their stories match and my brother
story seems more genuine because he was honest and straight forth about
everything. I didn't side with my brother because he is my brother, because if
that's the case I wouldn't have heard her out or checked to see if she was OK
or anything. We were best friends more like family, but I am a sister first. I
was concerned more about getting to the bottom of the story, because this
accusation would detrimentally affect my real family. I then went back to
Sharleeta house and asked her to retell me her story. Again she was
inconsistent and couldn't tell the exact same story I then began to feel she
had a different motive and was never raped." said Shiranette.
Shiranette: You OK?
Sharleeta:Yeah I'm cool
Shiranette: So tell me this story again. Is that a Plan B pill?
Sharleeta: We was drunk i was sleep and when i woke up and me and your brother was having sex, i was so wet the whole bed was. I felt him enter me though, but i was asleep then i woke up and waited a minute then when he was done i thrust out, turned around and told him to leave and i took a plan B to make sure.
Shiranette: The detectives just left you pressing charges?
Sharleeta: I don't know the detectives told me i cant beat my case without the other case.
Shiranette: What other case?
Sharleeta: The rape at the Fraternity house, The Ques.
Shiranette: Girl that whole story a lie Ole girl didn't even get raped, i don't believe not one piece to that story. Her and my brother never even had sex, That was a rumor. They are trying to build a case "A rumor" And "Facts" are two different things. They have no case or charges would have been brought up against him they wouldn't be waiting on your charge. You sound goofy.
Sharleeta: Well that's what they told me so i don't know if i am going to press charges. You know i am a Criminal Justice major and this is the second most violent crime in the world and your brother always get away with stuff.
Shiranette: So what you trying to do set him up? What does him getting away with things have to do with raping you? its either he did or he didn't. I need to know what your intentions are and motive this is my brother we like family or at least i thought. They clearly told you you do not have a case meaning they don't even believe you they need something else to add with this story. I'm about to leave your house this sound goofy because you keep changing your story and you cant repeat the same story twice and you letting these cops brainwash you. Do you understand where we are at they don't care about minorities here. I'm just here to get an education, I don't find this funny nor is this a game. Nobody believes you from friends to family, and I don't want to believe my best-friend would start such an accusation and do this to my family. What's your purpose? What are you gaining? Are you hurt? Traumatized? Anybody who rapes someone is mentally ill just like anyone who lies about it.
Sharleeta: No i'm cool, I'm not hurting or nothing he just always get away with stuff.

The alleged victim
did not try to fight off the alleged perpetrator, didn't use any force or a
weapon of any sort and the alleged victim did not sustain any physical injuries.
The alleged victim and the accused had a prior sexual relationship. You have to
be open to the idea that a woman might claim rape after consensual sex. This
can be determined by the relationships of the parties and their behavior. The
investigators should acknowledge that an act of sex was consensual or nonconsensual
are both plausible claims. For example, "you can’t change your mind that
the loan I gave you is suddenly a gift after you accept it, so the loan
agreement stands even if you claim the money was a gift". Lacking a
plausible alternative explanation and any other evidence of rape as opposed to
consensual sex demonstrates reasonable doubt.
It is 3 steps to this process Carbondale was
negligent to. There were three steps in this process that shows negligence by
Carbondale Police.
1) Making the decision to Charge Suspect
2) Analyzing corroboration
3) Trying the case
This was an Alcohol
Facilitated Sexual Assault in which the victim fabricated her story after first
admitting to being drunk. Therefore 28
WITNESSES had been gathered on Shamar’s behalf to contest to Marshall’s
fabricated story and Jackson County did not call one. He was convicted and
sentenced to 13 years with no evidence other than Marshall’s accusation. The
Scales Family and Petition Activist are asking that Shamar is granted a new
trial or exonerated.
