Marshall Press Charges after Premeditating for a week!
1 week after Accusation Marshall pressed charges.
Arrest Warrant
April, 18, 2013
a warrant was issued for Shamar's arrest. A warrant is issued for Shamar's
arrest on two Criminal sexual assault charges and 200,000 dollar bail for each
charge; Shamar immediately turned himself in April 19, 2013. One charge was from the
reported rape at the fraternity house that had no witnesses and Dymond Devost
never pressed charges nor showed up to one court date. Shiranette gathered
written statements in his defense and any evidence pertaining to the alleged
assault at the Fraternity house to include a written statement from Devost's
close friend. Devost's Case was dropped. Carbondale Police department harassed
Scales and threatened to lock her up for getting evidence and written
statements from witnesses to prove the accused innocence. They told her to send
all witnesses to them and to stop getting evidence they will get to the bottom
of both cases she didn't need to. Shiranette didn't listen and continued to
search for new evidence and ways to prove suspects innocence. Charges were
still against him in the Marshall case. Shiranette had a feeling Marshall never
told her mother "I was so confused and nothing made sense, this was my
little brother and my best friend. I know my brother and being a rapist is
completely out of his character, he always protected me. So they were going to
have to prove to me he did this well beyond words; he said she knew what she
was doing. Sharleeta and I were best friends I knew her like the back of my
hand, if this really happened her mother would know and if she doesn't it
proves that she is distorting the truth." stated Shiranette. Sharleeta
family have a very close relationship with her mother to her brother's, she is
the youngest girl in her family. Sharleeta’s mother was unaware of the charges
and accusation that her daughter has started. She didn’t tell her until months
after Shamar been in jail. Shiranette reached out to Mrs. Ida Marshall on
Facebook and asked her to call her because she wanted to make sure that she was
aware of the accusation Sharleeta has started in Carbondale. Ida confirmed that
Sharleeta never told her. Sharleeta then called Shiranette and asked why she
told her mom that it wasn't her place to do that. Shiranette and Sharleeta got
into a dispute and Shiranette cut all ties from Marshall and acquaintances.
Detectives then called Shiranette to tell her to stop all contact with
Sharleeta and her family and don't reach out to or call anybody else. Scales
went to TRIAL for Marshall's accusation November 12, 2013 and November 13,
2013. Scales was not given a fair trial, he was railroaded, there were African
American jurors but was not selected which created a bias jury.
Juries selected
in a racially discriminatory manner are done by illegally excluding minorities.
This is also organized by excluding people of color on the basis of race. Women
and Minorities must make up the population of jurors. Shamar Jurors consisted
of 4 women and 8 men, none of the African American decent. "Many defense lawyers
fail to adequately challenge racially discriminatory jury selection because
they are uncomfortable, unwilling, unprepared, or not trained to assert claims
of racial bias." Shamar was not given a proper defense nor did Carbondale Police Department take the time out to actually investigate this alleged
assault. They showed pure negligence and wanted to see this black man no where
but behind bars. A thorough investigation would include multiple interviews,
potentially multiple interviews of the alleged perpetrator, the victim, and
other witnesses, the collection of forensic evidence, medical records and
security camera's from hospital. All the victim had to do was state it was not
consensual then the accused had to prove it was. None of Shamar's witnesses
were called, in which his sister Shiranette Scales was subpoenaed but not
allowed on the stand.
After the trial and verdict Sharleeta
attempted to get an order of protection against accused sister which was denied
because of no proof of allegation. No matter the circumstances Sharleeta always
played the victim but with no evidence. Both, his Defense Attorney Margaret
Peggy Degan and The State's Attorney Casey Bloodworth failed to present
evidence in his defense (an abundant amount of evidence) that was excluded at
the Trial because it would have raised reasonable doubt. The State's Attorney
only presented evidence in their favor leaving a huge part of the story unheard
which led to the finding of guilty and harsh sentencing of the accused. Shamar
was sentenced to 13 years in prison and is required to do 85% of his time.
After Shamar was found guilty in November, his attorney was switched due to
incompetence of counsel from old attorney Margaret Peggy Degan to Celeste
Hamlin his new attorney. She stated she believes Shamar is innocent after
thoroughly investigating his transcripts and all evidence presented against
him. Celeste Hamlin put in a motion for a new trial. It was too late for her to
assist Shamar with a defense because he was already found guilty and awaiting
sentencing. Judge Schwartz’s mind was already made up, he didn't consider any
new evidence brought forth. A thorough investigation needs to be pursued so
that the investigation can yield evidence that the reported sexual assault had
in fact not occurred.
